Applying for
the Observer Function Authority

The Terms of Use apply to the customers (“the Applicants”) who apply for the use of the special function (“Observer Function”) that allows the Applicants to watch in-game matches of “ONE PIECE Bounty Rush” (“the Game”), published by Bandai Namco Entertainment Inc. (“the Company”).
The Applicants must carefully read the following terms and conditions before application.

Please note that by applying to this program, the Applicants are deemed to have agreed to the Terms of Use.

■Eligibility Requirements

The Applicants must meet all of the following requirements.

1. 1. Own a channel or account of video streaming platforms (YouTube, Twitch) designated by the Company and complete all required fields on the application form.
2. 2. Have at least 10,000 subscribers or followers on either the channel or account designated in 1.
3. 3. Have a Bounty Rush account on Steam.
4. 4. Comply with the Terms of Use, as well as the Game’s Terms of Service, Tournament Policy, and Streaming Policy separately established by the Company.
5. 5. Individual who are at least eighteen (18) years of age or the age of majority in the country individual resides (whichever is older), as of the date of the application.

■Application Process

1. 1. Application: The Applicants shall fill out and submit the required fields through the application form.
2. 2. Review: The Company shall conduct a review.
3. 3. Notification of the Results: Only successful Applicants will be notified through their registered email address.

Please note that:

1. (ⅰ) the review period is expected to take approximately two weeks;) however, it may take longer depending on the volume of applications and other factors;
2. (ⅱ) the Company will not reply to individual inquiries regarding the details of the review;) and
3. (ⅲ) accounts with a history of penalties, including but not limited to having their Observer Function revoked etc., will not be eligible for the review.

■ Guidelines for Using the Observer Function

Please adhere to the following guidelines.

1. 1. Comply with the Tournament Policy and Video Policy when the Applicants use the Observer Function to stream or create videos.
2. 2. The Applicants may not use the Observer Function to generate financial profit in any manner other than those specified in the Video Policy.
3. 3. The Applicants must clearly state the following “Required Copyright Notices” in the description section or similar location when using the Observer Function to stream or create videos.

■ Revocation of the Observer Function

The Company reserves the right to revoke the Observer Function without prior notice if the Company determines in its sole discretion that an account falls under any of the following cases.

1. (ⅰ) Violation (including suspect of violation) of the Terms of Use.
2. (ⅱ) If no login activity has been confirmed for over one month.
3. (ⅲ) If an application is submitted by impersonating another person’s channel or the Game account ID.
4. (ⅳ) If misconduct is discovered in the Game account used for the application (the investigation will cover within one (1)-year period prior to the date of application). Additionally, if misconduct is discovered after the successful application, such account will be subject to revocation.
5. (ⅴ) Any other cases where the “ONE PIECE” Intellectual Property or its stakeholder’s brand have been damaged or are at the risk of being damaged.

Please note that accounts which have been revoked are not eligible to reapply.

■Prohibited Actions

The Company reserves the right to revoke the Observer Function without prior notice if the Company determines in its sole discretion that actions fall under any of the following cases. Additionally, the Company may make allegations, including but not limited to requesting the removal of the content, if it contains prohibited actions.

1. (ⅰ) Any acts that violate the Terms of Use, Tournament Policy, Video policy, or the Terms of Service of the Game.
2. (ⅱ) Using the Observer Function in a manner that deviates from its intended observing purposes including but not limited to searching for, discovering, verifying, or disseminating bugs in stages or other in-game elements, non-standard behavior, or similar events.
3. (ⅲ) Any acts that involve unofficial modifications (MOD creation), as well as the use, publication, sharing, or dissemination thereof.
4. (ⅳ) Any acts that damage the image of “ONE PIECE,” the Game, or other games provided by the Company.
5. (ⅴ) Creating or distributing content that combines the Game with services provided by third parties.
6. (ⅵ) Any acts that cause or are likely to cause nuisance, disadvantage, or damage to the Company, other stakeholders, or third parties.
7. (ⅶ) Applying under a false identity, including but not limited to by impersonating another person’s channel or the Game account ID.
8. (ⅷ) Any acts or acts that are likely to insult, slander, or defame others.
9. (ⅸ) Any acts involving obscene, cruelty, or discriminatory content, or other acts that cause discomfort to third parties.
10. (ⅹ) Any acts that violate laws and regulations or acts against public order and morals.
11. (ⅺ) Any other acts the Company or its affiliates deem inappropriate.

■Disclaimer

In no event shall the Company be liable for any damage including but not limited to special, incidental, punitive or consequential damages of any kind or nature whatsoever the Applicants incurs in connection with the Company’s action under the Term of Use or granting of the Observer Function.

■Handling of Personal Information

The Company will use the personal information provided by the Applicants only to the extent necessary for the operation of this program and will not disclose it to the third parties except as required by law. For further details on how we handle personal information, please refer to our Privacy Policy.

■Relationship with the Company

Granting Observer Function does not create an employment relationship, outsourcing relationship, or any other similar contractual relationship between the Applicants and the Company. The Applicants are expected to act at their own risk.
